Household Waste Disposal: Your Duty of Care

As a householder, you have a waste duty of care. This means that you must only transfer your waste to someone authorised to accept it. Your waste is not just usual weekly refuse, but includes furniture, electrical items, building waste and green waste. By making sure that waste is handled safely and only passed to people authorised to receive it we can protect the environment and human health.

You must make sure that the person or organisation you choose to take away your waste is registered with the Natural Resources Wales.

Private businesses such as skip hire or house clearance should be registered as an upper tier waste carrier. Charities, voluntary organisations, and local authorities can collect waste with a lower tier registration.

If a waste enforcement officer traces fly-tipped rubbish back to a householder, they risk a fine of up to £5,000 and prosecution. Always make sure you keep a record of any checks you make, including the waste operator’s registration, permit or exemption number.  Local authorities across Wales can also issue the householder with a £300 fixed penalty notice as an alternative to prosecution.
